Unfair practice

A category of conduct prohibited under the Ontario CPA, including false, misleading, or deceptive representations and unconscionable representations. Engaging in an unfair practice is a separate ground for setting an agreement aside.

Unfair practices under the CPA include misrepresentations about the characteristics, benefits, or sponsorship of goods and services; false statements about price, value, or savings; and unconscionable terms taking advantage of a consumer's vulnerability.

The 2018 amendments specifically called out unfair practices in door-to-door HVAC sales: misrepresented energy savings, fictitious government affiliations, unfulfilled rebate promises, and grossly disproportionate pricing.
