Unconscionable pricing

A pricing structure where the total amount payable is grossly disproportionate to the value of the goods or services. One of the recognised grounds under the 2018 CPA amendments for setting an Ontario HVAC agreement aside.

The unconscionable-pricing ground captures the central pattern of door-to-door Ontario HVAC contracts: 10-to-15-year rentals or financings whose total obligation runs many times the equipment's true installed value.

There is no fixed multiple required for a finding of unconscionability — it is a fact-driven analysis. But cumulative obligations several times the equipment's value, paired with a door-to-door sale and limited disclosure, regularly support the conclusion.
