Default judgment

A court judgment entered against a defendant who failed to file a defence within the prescribed time. Setting aside default judgment is possible but harder than responding within the original deadline.

Default judgments in Ontario HVAC collection cases are common where the homeowner missed or did not understand the defence deadline. Motions to set aside are governed by Rule 19.08 (Superior Court) or analogous Small Claims rules.

Time matters: the longer a default judgment has been in place, the harder it is to set aside.
